Any guarantee or contracts are pursuant to the LeadGenerator Terms of Agreement and Conditions as stated below.
- LeadGenerator Duration of Contract: LeadGenerator programs are auto-renewing, annual contracts and any guarantees made will follow the twelve months after the anniversary of the contract start date listed above, not the date of signature. In order for this contract to be in effect the signature date must fall within 4 days of the starting date listed in the Contract Date field.
- Minimum number of monthly leads: Leads are determined by the number of people that register for your offer through SermonView marketing efforts—not interests that accept your offer. Duplicate responses within 30 days, obviously made up responses will not count toward your final lead count, or leads that extend over 3 miles past your target range. SermonView is not responsible for vetting lead information, false leads need to be reported to SermonView within 30 days of receipt in order to receive a credit against guarantee. Monthly is determined by a full calendar month, not a set number of days. Leads generated through efforts outside of SermonView will not count toward your guarantee.
- Satisfactory Month: Any calendar month that meets the Minimum number of leads based on section 2 is considered a “Satisfactory Month”
- Lead Guarantee: The Lead Guarantee states that if any month does not qualify as a satisfactory month SermonView has thirty days to satisfy any deficient leads along with satisfying that current month's leads. If leads are not made up within 30 days the customer has 2 options:
Option 1: Reduction of Services. The Customer can request a reduction of services and receive a credit for any additional balance left over from the difference between the original contract and the reduced contract.
Option 2: Cancellation. The Customer has the prerogative to cancel services and receive a full refund for the current years installment—minus the current number of leads received (regardless of our costs). The value of leads will be based on the original program level, as stated in the contract.
The customer shall be informed within 10 days after the end of any Non-Satisfactory Month, by the provided email in their account. If the customer does not make a decision of option within 30 days of any unsatisfactory month then the options are revoked and the contract continues as originally stated.
- Guarantee Qualification: In order to receive guaranteed leads churches are required to give SermonView enough zip codes to match the population required for the subscription level. Population estimates on this agreement do not guarantee actual numbers, which will be determined using Facebook Ad Manager before the campaign is started. If the actual numbers do not match the estimate a campaign manager will contact you to let you know that we need to change the subscription limit, remove the guarantee, or give you an opportunity to cancel your agreement within 7 days of receipt of your signed agreement.
- Contract Auto-Renewal: Within thirty (30) days of the anniversary of the contract start date an invoice will be sent out to the participating church. If the church does not wish to continue the program into the new year, they can inform SermonView by email, mail, or phone of their desire to cancel at the date of their anniversary. If no contact is made it is assumed that the church wishes to continue the program for another twelve (12) month cycle. Churches will be notified of anniversary dates by the receipt of invoice and a reminder email to the contact on file. Lack of receipt of this email does not constitute termination of any additional parts of this agreement.
- Cancellation: This agreement can be canceled at any time with 14 days written notice. Cancellation for any reason outside the terms of the Lead Guarantee Policy, or during the annual renewal window, are subject to reimbursements at SermonView's discretion and will be determined based on the marketing activities rendered. Upon cancellation, a church's offer code will go inert and any response from outstanding marketing efforts will be forfeit.
